When the overseas manufacturer is beyond reach, the importer may become the practical target.
Importing changes the liability, contract, testing, traceability and recovery picture.
Why importers are different
A U.S. importer can be drawn into a claim because it introduced the product into the domestic market, selected the supplier, specified the product, applied its brand or is the most reachable defendant. A foreign supplier’s certificate is not a substitute for your own coverage.
Supplier insurance and indemnity
Review governing law, indemnification, insurance requirements, additional insured status and the financial ability of the supplier to honor its promise. Contractual protection and insurance work together, but neither automatically replaces the other.
Testing and compliance
Document applicable standards, third-party testing, inspections, labeling, warnings and change controls. Ask what happens if the factory changes materials or subcontractors without approval.
Coverage territory and recovery
Confirm where claims must be brought for coverage to apply and whether the carrier can pursue responsible suppliers. International sales or foreign subsidiaries may require separate solutions.
